Untilt Terms of Use
These Terms of Use govern your access to and use of Untilt, a mobile application and related web services for tracking trading behavior, reviewing uploaded trade data, and improving process discipline. By creating an account or using Untilt, you agree to these terms.
1. Who May Use Untilt
You must be at least 18 years old and able to form a binding agreement to use Untilt. You are responsible for keeping your account credentials confidential and for all activity under your account.
2. Educational and Analytical Use Only
Untilt provides behavioral tracking, analytics, journaling, scorecards, charts, and related process feedback. Untilt does not provide financial, investment, tax, legal, brokerage, or trading advice. You are solely responsible for your trading decisions, risk management, and compliance with any rules that apply to you.
3. Your Data and Uploads
You may upload trade exports, notes, tags, scorecard responses, and other content that you choose to provide. You retain ownership of your content. You grant Untilt permission to host, process, display, and analyze that content only as needed to operate, maintain, secure, and improve the service.
4. Acceptable Use
- Do not use Untilt for unlawful, deceptive, abusive, or harmful activity.
- Do not attempt to access accounts, systems, data, or features you are not authorized to use.
- Do not interfere with, reverse engineer, scrape, overload, or disrupt the service.
- Do not upload malware, exploit code, or content that violates another person's rights.
5. Subscriptions and Billing
Some Untilt features may require a paid subscription or in-app purchase. Prices, billing intervals, trials, renewals, cancellations, and refunds are handled through the applicable app store or payment provider unless we state otherwise. Your access to paid features may change if payment fails, a subscription expires, or a purchase is refunded.
6. Availability and Changes
We may update, suspend, or discontinue parts of Untilt at any time. We work to keep the service available, but we do not guarantee uninterrupted access, error-free operation, or permanent availability of any feature or data integration.
7. Third-Party Services
Untilt may rely on third-party services for authentication, analytics, app distribution, market data, hosting, or payment processing. Those services may have their own terms and privacy practices. We are not responsible for third-party services outside our control.
8. Privacy
Your use of Untilt is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights.
9. Termination
You may stop using Untilt at any time. We may suspend or terminate access if we reasonably believe you have violated these terms, created risk for other users or the service, or used the service unlawfully.
10. Disclaimers
Untilt is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
11. Limitation of Liability
To the fullest extent permitted by law, Untilt and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for trading losses, lost profits, lost data, or business interruption arising from your use of the service.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be reflected by updating the “Last Updated” date and, when appropriate, by notifying users through the app or website.
